Attorney and medical doctor Spencer Mynko has created a law practice dedicated to defending healthcare professionals against accusations from their state licensing boards and federal agencies, such as the DEA and CMS.
I was disciplined by the medical board because of chemical dependency. I confronted my addiction, but also created the evidence necessary to convince the board that I took responsibility for and dealt with my problem in a meaningful way. Having walked through the process successfully, I am proud to say that my medical license was fully restored and remains unrestricted, along with an unrestricted DEA certificate. As a result, I know where you are and what you are going through because unlike any other lawyer you may consult with, I have been there and have gone through it myself. As such, this provides me with a unique perspective as both a physician and a lawyer and not only understanding the process, but what a healthcare professional must do in order to maintain or retrieve their license and protect and save their career.
In my opinion, cases are not won or lost based on clever lawyering. Cases are won or lost based on the facts. Other websites are replete with lawyers who talk about how brilliant and experienced they are, but what they don’t tell you on their websites is that ultimately it is you who is responsible for creating the facts that will support your arguments and convince the boards to let you continue to work in a professional capacity. You create the narrative. A good lawyer can tell the story, and guide their client through the process, but you and you alone must walk the path.

The Medical Board of California is responsible for issuing licenses to medical doctors, and is the agency that investigates complaints against medical practitioners and imposes discipline for violations of the Medical Practice Act. The primary mission of the medical board is ensure only qualified physicians are licensed to practice in order to protect the public from incompetent physicians.
The Medical Board of California receives thousands upon thousands of complaints every year from various sources, but most typically patients. When the medical board decides to evaluate a complaint, they will be looking for misconduct based upon: gross negligence in the treatment and care of patients, alcohol or drug abuse, healthcare fraud, inappropriate prescribing, substandard or dishonest documentation and medical recordkeeping, sexual misconduct, and criminal convictions that bear upon the physician’s ability to practice medicine.
Other licensing boards (Osteopathic Medicine, Nursing, Dentistry, Pharmacy, etc.) operate according to the same basic scheme - they are responsible for regulating their licensees, protecting the public, and meting out discipline as they see fit. And none of them are your friends.
